A couple who have successfully sued to stop neighbours smoking on an apartment balcony may have opened up a can of worms.

The pair have won a ruling in the New South Wales Civil and Administrative Tribunal after complaining of persistent tobacco smoke, drifting from the apartment below.

Strata Communities Association President Stephen Brell told John Stanley the victory sets a precedent for smokers in apartment buildings.
