No justice: DPP’s ‘bizarre’ decision for alleged drunk driver
Ray Hadley has revealed a “fresh detention application” won’t be made for a Bellingen woman who allegedly killed a 9-year-old boy while drink-driving.
Kristie Fiona Anne Merrett, who faces a possible sentence of up to 14 years in jail if found guilty, remains on bail after a fatal car crash on the NSW Central Coast earlier this year which claimed the life of 9-year-old James Edds.
“She’s happily at home … while the family is left to bury a child that should have never died,” Ray said. “It’s just bizarre.”

“At the Attorney General’s request, the Director of Public Prosecutions requested the relevant material in R v Merrett to give consideration to a fresh detention application.
“We have subsequently been advised that having closely reviewed the material, her Office has determined that a fresh detention application will not be made at the present time.
“The ODPP has confirmed, in response to a further request from the Attorney General, that the ODPP has been in contact with the family in this matter, consistent with Chapter 5.4 of the ODPP’s guidelines, and that the family are aware of the ODPP’s decision not to lodge a fresh detention application.
“The Attorney General will continue to closely monitor this case.”
