An 18-year-old has been told by a NSW magistrate that he can smoke cannabis as part of his bail conditions.

The teenager appeared before Kempsey Local Court Magistrate David O’Neil on Monday, charged with car theft.

His bail conditions included “Not to drink alcohol or take drugs, other than cannabis, unless those drugs are prescribed by a doctor”.

The decision has since been reversed but the NSW Attorney-General Mark Speakman has urgently requested the court transcripts.

“[The] decision from a magistrate has got me scratching my head this morning.”
