‘Are you serious?’: Cruise company cops legal action over bad weather

Passengers who travelled on P&O’s Pacific Aria in 2017 are taking legal action over their South Pacific cruise to Noumea and Vanuatu, demanding a refund on their tickets and damage payments.

Passengers say the boat sailed into the path of a Category 5 cyclone, and they were given no pre-boarding cancellation option, board activities were cancelled and some seawater entered their cabins.

Director of Carter Capner Law, Peter Carter, is leading the class action that is suing P&O for “damages for disappointment”.

“The vessel should never have departed and the cruise company under Australian law must compensate all 1200 passengers,” Mr Carter told Ben Fordham.
