General Terms & Conditions 2GB - 2015

Examples of minor promotions on Radio 2GB:

1.Alan Jones Music Segment:

Everyday during the breakfast program Alan Jones asks listeners a question relating to the CD of the week. The nominated caller/s through with the right answer will win a general prize.

 

2.Chris Smith ‘Smithys Quiz’ Segment:

Everyday during the afternoon program Chris Smith will ask quiz questions. The format is a last man standing quiz, with callers answering questions until they get one wrong, then revert to the next caller. The last caller to answer question 5 correctly will win the general prize/s.

 

3.Ben Fordham Happy Hour:

Every Friday during the drive program Ben Fordham will cue ‘Happy Hour’. The nominated caller/s through will win the general prize/s.

 

4.Sportszone Quiz:

Every Friday clues to a person or thing will be given out throughout the Sportzone program. The nominated correct caller/s through will win the general prize/s.

 

5.General Prize Sheet:

Various general prizes are given away as part of quizzes, segments and/or as gifts to listeners during the week. These are at the announcer's discretion.

Prizes:

General prizes include CD's, DVD's, flowers/fruit, books, games, toys, movie passes, theatre tickets, restaurant vouchers, accommodation vouchers etc.

 

Terms & Conditions:

These terms and conditions will be available to view at 2GB.com during the time of its validity.

All winners are automatically entered on the 2GB Promotions Database.

Only one minor prize can be won by any one listener OR a member of the same family within a THREE week period.

Only one minor prize can be won per household within a THREE week period.

Only one minor prize can be won by a member of an immediate family within a THREE week period.

Only one major prize can be won in a competition conducted by any station of the Macquarie Radio Network by any one listener within a twelve month period.

For any end of week draw, only one entry per person will be accepted.

The maximum single value for a major prize is worth $1,000, unless otherwise specified in an additional permit.

Where specified, prizes may need to be collected from the studios/office of Radio 2GB. If a prize is required to be collected and the winner cannot collect, the winner will incur the cost of a courier, postage or forfeit the prize.

All winners contact details are retained for administrative purposes only.

Winners who ‘opt-in’ to receive information from external companies may be contacted by those companies for any purpose.

No information will be disclosed to anyone outside 2GB.

All Prize fulfilment can take up to four weeks due to the amount of prizes given away.

Once the prize has left the offices of Radio 2GB we hold no responsibility regarding breakages or loss of parcel. In case of lost mail the winner will need to liaise directly with their local post office. 2GB will make every effort to help the situation but replacements are not guaranteed.

If the prize is not available due to unforseen circumstances Radio 2GB reserves the right to exchange the prize for something of equal value.

Judges decision is final. No correspondence will be entered into.

Winners cannot exchange prizes for cash or for any other prize.

Current Employees of the Macquarie Radio Network and their immediate families and group companies and any other company associated to the specific competition are not eligible to enter the competitions.

Unless otherwise advised, only residents of the 2GB listening area in New South Wales are eligible to enter competitions and win prizes.

Radio 2GB reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the promoter.

All contestants release from, and indemnify 2GB and the Macquarie Radio Network against all liability, cost, loss or expense arising out of accepting the prize or participation in the competition including but not limited to loss of income and personal injury.

If the winner is under the age of 18 years, the prize may be awarded to the winner's parent or guardian.

Radio 2GB has the right to temporarily or permanently disqualify any person from taking part in any promotions or competitions if the station, in its sole discretion, deems that person to have broken the rules of the general prize giveaways. The person will be advised of this in writing after the decision to disqualify has been made.

In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

In the event that for any reason whatsoever a show, concert or event is cancelled radio 2GB will not be held liable to replace the prize. Replacement prizes will be at the discretion of the promoter.

At no time will Radio 2GB be held responsible for faults or drop outs in telephony or other IT communication in relation to on-air contesting, whether in the contestants device or connection or Radio 2GB's device or connection. In such an instance, no compensatory prizes or allowance will be made.

Radio 2GB may at any time and  in its absolute discretion alter, amend, add to, waive or enforce the General Competition Rules and any Specific Competition Rules with present, future or antecedent effect as it sees fit.

Each entrant consents to the content of their entry and any telephone entries or other call with the Promoter being recorded, broadcast and published online by the Promoter without payment.

All winners may be required by Radio 2GB in its absolute discretion to:

-        Participate in promotional activities for the benefit of Radio 2GB.

-        That he or she will not, without prior written consent of Radio 2GB (which maybe with held in its absolute discretion) participate in any other media activities, promotions for the purpose of or which involve discussion, commenting on, expressing a view on the account of the competition.

-        In promotional activities the winner will refrain from expressing a negative or disparate view of Radio 2GB or parent company the Macquarie Radio Network and its operations and related bodies.

-        The winner acknowledges and agrees that Radio 2GB has the right to all materials generated in connection with the promotion and can use the material in any medium and in any manner it sees fit.

-        Radio 2GB will also hold the copyright to any photographs, video footage or written comment taken for publicity purposes and can use these items in any promotional material for the time period of five years.

-        Competition winners agree to keep confidential any knowledge of Radio 2GB and its business and personnel received by them as a result of the competition.

 

Use of false name or address, i.e. name by which the entrant is not usually known will disqualify them from receiving the prize.

 

Acceptance of entering the competition is deemed acceptance of the terms and conditions.

 

All correspondence regarding prizes must be in writing to the Promotions Department at Radio 2GB.

 

All correspondence will be answered within a three week period.

 

Notwithstanding any other condition of these specific competition rules, Radio 2GB reserves the right to withdraw the competition at any time and for any reason whatsoever.

 

The promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize(s), except for any liability which cannot be excluded by law.

 

If the prize requires travel it will be each prize winner’s and (if applicable) their accompanying guest/s responsibility to take out all relevant insurance (including but not limited to travel insurance) which may be required or prudent to be taken (at their own cost) unless otherwise specified.

For Web Entries

1.     Participants will be required to their personal details including, but not limited to, name, address, phone number and correct answer. Incomprehensible entries will not be included in the draw.

2.     Entries must be received by the disclosed time (AEST/AEDT) on disclosed date.  The time of entry will in each case be the time the registered on the website.

3.     The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.  The Promoter is not responsible for any incorrect or inaccurate information, either caused by the web user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

4.     If for any reason if the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

Inaudible and incomprehensible recordings will not be included in the draw.

  11. A winner has rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These rights include a statutory guarantee that any services provided by the Promoter will be rendered with due care and skill and that any goods will be of acceptable quality. These Conditions of Entry do not exclude, restrict or modify those statutory rights in any way. However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, other than the Australian Consumer Law, regarding the quality and suitability of the prize awarded under these Conditions of Entry and will not be responsible for breach of any such implied terms.
  12. The Promoter and its agencies and representatives associated with this Promotion, including and/or a nominated Prize Provider, will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person’s negligence) relating to this Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).
  13. The entrant acknowledges that there may be inherent risks involved in entering this Promotion or taking or participating in the Prize(s).  If Entry or a Prize involves travel, stunts or challenges the Promoter may require the participants to:
  • Submit to a medical examination by a medical practitioner approved by the Promoter and obtain relevant medical clearance to participate in the Promotion and/or redeem a Prize; and/or
  • Execute a Deed of Release and Indemnity in a form prescribed by the Promoter in order to participate further in the Promotion and/or redeem a Prize.
  • The Promoter and/or a nominated Prize Provider, accepts no responsibility for any tax implications that may arise from winning of the prizes.  Independent financial advice should be sought.  The Promoter takes no responsibility for variations in the prize value.
  • By entering the Promotion, the Entrant agrees to the Promoter’s Privacy Policy as amended from time to time and available on the Promoter’s website.

 

ADDITIONAL TERMS & CONDITIONS

 

 

  1. The winner will be provided with documentation to enable them to make arrangements with Compagnie du Ponant Ltd to receive their prize.

     

  2. If the prize or any part of the prize becomes unavailable for reasons beyond Compagnie du Ponant Ltd’s reasonable control, COMPAGNIE DU PONANT LTD will endeavour but is not obliged to provide a substitute prize of equivalent value.

     

  3. COMPAGNIE DU PONANT LTD reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

     

  4. The winner and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or Perth).

  5. If the winner is from ACT or not within their nearest capital city to the nearest flight departure capital city will be included in the prize package for the winner and travelling companion only.

  6. The prize must be taken between 1st September 2017 and 11th September 2017.

  7. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule.Frequent Flyer points are not available from any airline.

  8. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

  9. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.

  10. We make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

  11. FOR DESTINATIONS WITH TRAVEL WARNINGS: The winners are required to be physically fit. This expedition/prize is not suitable for anyone who suffers from a respiratory disorder, circulatory ailment, or physical disability that limits mobility. By entering the competition, the winner and their guest acknowledge they are able to bring with them with the required clothing for this tour at no expense to PONANT or the other organisers.

  12. FOR ALCOHOL PRIZES: Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines that are available at:

  13. Unless expressly stated in these terms and conditions all other expenses such as:

    (Travel to/from the airport from/to winner’s residence, spending money, airport fee etc.) become the responsibility of the winner.

  14. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

  15. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

  16. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

  17. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

  18. Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at 30th August 2016.

 

 

 

GENERAL

 

  1. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.

  2. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

  3. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

  4. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

     

  5. In the event that for any reason whatsoever the prize winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu of the prize or that element of the prize.

     

  6. All prizes must be taken as offered. Prizes, or any unused portion of a prize, are not transferable or exchangeable. Prizes are valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. Failure to follow the standard rules and guidelines presented will result in the winner forfeiting their right to receive their prize.

     

  7. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.

     

  8. It is a condition of accepting a prize that the winner agrees to be interviewed, photographed and filmed at any time during the acceptance of the prize by the Promoter or their agents for a story or feature on this promotion to be developed and featured as part xxx network (or any other form of media it deems suitable) without further remuneration or reference to the participant.   9. Entrants agree that they may be interviewed, photographed and/or filmed at any time during their participation in the promotion.
