Are courts too soft on criminals?

There's criticism of the state's courts, with only a handful of criminals handed maximum sentences. Apart from murderers and drug smugglers jailed for life, just five people received maximum sentences in the last decade.

The maximum 25 year jail term for manslaughter was only handed down once. Rapists, armed robbers and burglars all escaped the harshest penalties Victims groups say there is no point in having the harsh maximums if they will never be used.

But a spokesperson for Attorney General John Hatzistergos insists statistics showed sentences are becoming harsher.

My daughter was gang raped by 4 youths. Two received 18 months good behavior bonds earlier this year. The other two were sentenced in the Griffith District court Yesterday They also received 18 months good behavior bonds.The case yesterday was different to the earlier one as the Judge had all the facts before her including the fact that my daughter claimed that it took 3 months for her anus to heal.Me and my family are totally shattered by the sentence. Please help us expose this madness. Rick

The court system has utterly failed us as a community.They are unjustifiably far too soft on criminals.As such a failed system,it is long overdue for a thorough independent review, including the selection, appointment, discipline and promotion and review of 'services'of magistrates and judges.Some crimes,in particular vicious wanton unprovoked assaults like the one on the defenceless man in his wheelchair at Mount Druitt railway station require mandatory sentencing and a flogging with the rattan

the person who summed it up on Fri 5th, took the words out of my mouth, I would only ad that to make it a crime for the things like being drunk, and maybe import ideas like chain gangs in au,( to chip noxious weeds eta. ) might make some people think twice

Of course they are. I don't know anybody who thinks that the sentencing is adequate. As was discussed on 2GB a couple of weeks ago they should have minimum sentencing instead of the current stupidity they carry on with.

To Molly Daveson. Fortunately, the judiciary is independent & can hear all the facts. Often, the press pick up on selected cases & then only report selected parts to increase the sensationalism that sells newspapers & increases ratings of their TV programs. I prefer an independent judiciary, particularly if I was arrested. If you were arrested, I am sure that you would prefer one too.

YES!. I cannot understand why ACCC has not investigated the Australian Judiciary from top to bottom. Most workplaces have a Human Resource centre that is responsible for behaviour in the workplace, but not this seemingly untouchable mob.Many of their judgements have failed the safety of Australian citizens. Why haven't our politicians stepped in and straightened them out instead of ignoring bad judgements made by them.

An article in the SMH on Saturday 27th Feb indicates a proposed change to DSM (Diagnostic and Statistical Manual of Mental Disorders) which will allow a serious potential for misuse in the court system. Manual is open for comment until April (article did'nt say where to comment),estimated publishing date 2013. Classifies Rape as Paraphilic Coersive Disorder. Definition is included in the article.
Potantially rapists could be admitted to hospitals instead of gaols.

I don\'t know how some Judges sleep at night. I\'m referring to that pedophile that Ray Hadley talked about this morning. The 32 yr old man having sex with that 12 yr old girl, and getting less than 2 years? It\'s very worrying for parents in the future because what is it telling future pedophiles? It\'s worth it! It\'s disgusting.

Yes! Our judiciary is a joke! When premeditated rape or murder isn\'t in the worst category of crime, I despair! Graffiti is another thing that really gets up my nose. We need to have a few of these people who want to destroy other people\'s property taught a lesson or two and maybe it will stop. The police have to be given more power and backed up. What is happening to this country with all the knifings, glassings, etc. It\'s frightening!
