John Watkins would not hold his place in too many sporting teams.

His performances are too erratic.

The Opposition at Macquarie Street are saying quite rightly that Mr Watkins has an obligation to explain to the Parliament why the terms of reference for the Special Commission of Inquiry into Sydney Ferries specifically excludes the two fatal accidents involving Sydney Ferries on January 5 this year and March 28.

But when the Parliament was debating the terms of reference for the Special Commission of Inquiry Minister Watkins didn't even show up in the Parliament.

He's the Deputy Premier.

Morris Iemma told the public days after that awful tragedy on March 28 "Recent incidents involving Sydney Ferries have made it clear to me that it's time to put the spotlight onto the entire operations of the Sydney Ferries Corporation from top to bottom."

And the Premier told commuters after the incident, which remember claimed four lives, "There'll be a thorough, robust and transparent investigation into what occurred."

Well, how can you have a thorough and transparent investigation when one of the best minds in the country, Bret Walker, is heading an inquiry into Sydney Ferries with terms of reference excluding him from inquiring into the reason or reasons for the deaths on March 28 and January 5.

The Opposition are saying the terms of reference of Bret Walker's inquiry should be extended to prevent the exclusion of the two fatal crashes.

Bret Walker should be asked to investigate these two fatal accidents in open court in full view of the public.

No more, no less.
